SDA 113: Student-Athlete Medical Hardship Petitions

Purpose

To define the policy for petitioning the Pac-12 Conference to allow a student-athlete who suffered an incapacitating injury or illness to regain a season of competition in accordance with NCAA and Pac-12 Conference rules and guidelines.

Policy

[horizontal rule]

  1. Criteria – To be eligible for a medical hardship waiver, a student-athlete must have missed a season of competition because of injury or illness related (medical) hardship as provided under NCAA Bylaw 12. The Compliance Office will review waiver requests and only submit requests under this policy that meet these criteria.

Who makes the ultimate medical determination – The team physician has final decision-making authority as to whether a student-athlete’s injury or illness meets the medical criteria for a hardship waiver. It is his or her responsibility to exercise independent professional judgment and objectivity when making the determination.

Physician’s discretion to seek outside expertise – If a student-athlete’s injury or illness is determined by the team physician to be outside the physician’s practice scope or expertise, the physician, in the physician’s sole discretion, may allow a non-ASU physician to determine whether the injury or illness has met the medical criteria for a hardship waiver.

  7. No undue influence – SDA coaches and staff are prohibited from attempting to pressure any individual to support a medical disqualification when one is not justified under NCAA legislation.

  9. Authority to request – The Compliance Office will only submit hardship waivers to the Pac-12 Conference at the request of the head coach or sport Administrator.
