Is the employee entitled to Military Leave?
Any current regular employee who is a member of the Arizona National Guard and Reserve or an armed forces branch of the U.S. Military (Army, Navy, Air Force, Marines, Coast Guard) or is called into active military duty is entitled to Military Leave under ASU policy.
What is the purpose of Military Leave?
To provide current regular employees a leave of absence for military service with protection of employment status and, if applicable, continuation of pay, benefits (for family members) and retirement plans.
When is the employee on leave with pay
vs. leave without pay?
The employee may have a leave of absence with pay for active duty or training not to exceed 30 calendar days in any two consecutive federal fiscal (October 1–September 30) years. Leave of more than 30 calendar days must be taken as leave without pay or by using accrued vacation or accrued compensatory time. During leave without pay, an employee will not accrue sick or vacation leave.
What procedure should the employee follow
for requesting Military Leave?
Employees must meet with the supervisor and complete a Leave of Absence Request Form form for the department. A consultation with a HR Benefits Representative is necessary to complete the Military Leave of Absence Record and review the employee's rights.
What provisions are made for employment status, salary
and benefits while the employee is on Military Leave?
Regular employees reemployment rights are protected under the Military Leave policy. The employee maintains rights to the same seniority and benefits that they had prior to military leave as well as any that would have been accrued had the employee been continuously employed.
Are temporary employees of ASU protected
under the Military Leave policy?
Temporary employees are not considered benefits-eligible and are employed for only a short duration. Therefore, the policy does not apply.
