An Independent Contractor is a person contracted to perform a particular service where there is no right to control the person who does the work and no right to direct the manner in which the job is done.

SPP 210 (Consultants/Independent Contractors) requires that Human Resources (HR) review the pertinent facts related to the purchase of services before departments hire an independent contractor.

HR must determine whether:

  • an individual is currently employed by ASU;
  • whether a true employee-employer relationship exists;
  • whether nepotism is a factor; and
  • whether services could be provided through existing university hiring procedures.
