The Code governs the conduct of operators only, except when pedestrians are in the proximity of emergency personnel and must yield the right of way.
Safety and courtesy are the foundations of the Code.
The Chief of ASU Police and the Director of Parking & Transit Services may use discretion to address situations not covered by the Code.
There is a well-defined community standard of conduct for operators.
With one exception, the Code addresses behavior, not mode. The only mode specifically prohibited at this time is the motorized scooter, i.e. “go-ped”.
A service animal, as employed by a person with a disability, will have the status of pedestrian.
Rights of Way are clearly defined.
Reasonable and fair enforcement is stated as a priority and guidelines for enforcement have been provided.
All proceeds from fines will be deposited into the Mall Safety Fund, which is dedicated to community education about the Code.
An operator of a vehicle is required to have a valid driver's license.
A citation may be issued for a violation, and impound of property may occur in conjunction with such a citation, regardless the availability of proper identification.
Three levels of violation have been defined and are associated with three levels of fine.
An enforcement officer may include aggravating circumstances in the assessment of a violation.
Two types of speeding violation have been defined.
A fuel-powered vehicle may not be brought inside any building, except those areas designated for such use, e.g. a garage.
Operation of a non-pedestrian device or vehicle inside a building is prohibited.
Only “simple transit” is authorized. Simple transit is defined as the minimum actions necessary to go from one place to another. “Thrillseeking” is prohibited because it is not “simple transit”.
An enforcement officer may exercise discretion to prohibit unsafe or discourteous conduct not specifically addressed in the Code.
An operator must immediately comply with any instruction relevant to the operation of a non-pedestrian device or vehicle issued by an enforcement officer pursuant to enforcement of the Code.
Parking structures are reserved for the use of vehicles and pedestrians only. Operation of a non-pedestrian device is prohibited in a parking structure, except for members of the ASU Police Bicycle Patrol.
A vehicle may not be left unattended with the engine running nor in a manner as to allow operation by an unauthorized person.
An enforcement officer may impound and remove without notice any property deemed to be a public hazard or to have been abandoned.
Additional penalties & sanctions may be employed against those who do not remedy a citation within a specified time.
Appeals will be handled by the current system in place at the ASU Parking and Transit Services Division and the Parking Citation Appeals Board.
Citations may be remedied through education via the Mall Safety Training class to be instructed by members of the campus community and the ASU Police.
The code may be revised, modified or amended upon approval of the President.
Definitions of selected words specific to the application of the Code on the campus have been provided.
