SPP 404–08: Nonexempt Employee Electronic Communications

To instruct nonexempt employees on guidelines concerning use of electronic communication devices when not scheduled for work duty

ASU employees may perform job duties using a variety of electronic communication devices, depending on the nature of the work and responsibilities involved. Some of the required communication mediums may include cellphones, laptops, tablets, etc. The efficient operation of the university, and service to students, may occasionally require the use of these devices by non-exempt staff outside of the normal work schedule.

As with other types of authorized work, all time spent by nonexempt employees using electronic communications for work purposes will be considered hours worked whether within or outside the non-exempt employee's regular work schedule; the time is compensable and will count toward overtime eligibility as required by law.

Employees are responsible to accurately and timely report and record all time worked. All hours worked will be paid or compensatory time accrued in accordance with the Fair Labor Standards Act.
